§1. General Provisions
- These Terms and Conditions ("Terms") govern the provision of electronic services by the website available at www.sendgoodfeelings.com (the "Service" or the "Website").
- The Service is operated by SendGoodFeelings, an online-only business (the "Service Provider", "we", "us").
- The primary and preferred contact method is email: contactsendgoodfeeling@gmail.com.
- These Terms apply to both:
- Consumers (individuals acting for purposes wholly or mainly outside their trade, business, craft or profession), and
- Business Users.
- The Service consists of the creation and delivery of personalised video content generated using artificial intelligence (AI), based solely on the information, descriptions and parameters provided by the User during the ordering process.
- Each video is created individually on request and is not pre-made.
- To use the Website, the User must have an internet-enabled device and a compatible web browser.
- By placing an order, the User confirms that they have read and accepted these Terms and that the Service is commissioned according to their individual requirements.
§2. Definitions
- Website / Service – the website available at www.sendgoodfeelings.com
- Service Provider – SendGoodFeelings
- Service – creation and delivery of a personalised AI-generated video
- User / Customer – any individual or legal entity using the Website
- Consumer – an individual acting outside their trade or profession
- Order – a request submitted via the Website to purchase the Service
- Video / Content – the final personalised video generated by AI
- Order Form – the online form where the User specifies parameters of the Service
§3. Ordering and Contract Formation
- To place an Order, the User must complete the Order Form and provide all required information, including a valid email address.
- Submission of the Order constitutes an offer to purchase the Service.
- A legally binding contract is formed when the Service Provider sends an Order confirmation email accepting the Order.
- The User is responsible for ensuring that all provided information (including details relating to any third party featured in the video) is accurate, complete and lawful.
- The Service Provider reserves the right to refuse or cancel an Order if its content violates §7 of these Terms.
- The Service Provider may reasonably adjust or shorten user-provided dialogue or wording if it exceeds technical limits (e.g. maximum speech duration per scene) or would negatively affect the technical or artistic quality of the Video.
§4. Prices, Payment and Delivery
- All prices are displayed in British Pounds (GBP) and include VAT where applicable.
- The final price depends on the selected video length and optional add-ons (e.g. music, express delivery).
- Payment is required in advance and is processed via third-party payment providers such as Stripe, PayPal, Apple Pay or Google Pay.
- Standard delivery time is up to 24 hours from payment confirmation.
- Express delivery (approximately 5 hours) is available for Orders placed before 5:00 PM UK time (GMT/BST).
- Orders placed after this time may be processed as standard, and the express fee is non-refundable unless expressly agreed otherwise prior to purchase.
- The finished Video is delivered electronically via download link or email attachment.
§5. Right to Cancel (Consumers)
- In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Consumers normally have a 14-day right to cancel.
- However, this right does not apply to personalised digital content once performance has begun with the Consumer's prior express consent and acknowledgement that the right to cancel will be lost.
- By placing an Order, the Consumer:
- expressly requests immediate performance of the Service, and
- acknowledges that they will lose the right to cancel once the creation of the personalised Video has begun.
- This does not affect the Consumer's statutory rights in case of faulty or non-conforming content.
§6. Complaints and Faulty Content
- The Consumer has the right to remedies if the Video:
- does not match the key parameters selected in the Order, or
- is not provided with reasonable care and skill, as required by the Consumer Rights Act 2015.
- Due to the creative and AI-generated nature of the Service, the User acknowledges that:
- the final visual style is an interpretation of textual input,
- minor differences in appearance, colour, background details or artistic interpretation do not constitute a fault.
- Complaints should be submitted to contactsendgoodfeelings@gmail.com, preferably within 7 days of delivery, including:
- order number,
- description of the issue,
- the delivered Video file.
This timeframe does not limit statutory consumer rights.
- If a fault is confirmed, the Service Provider may:
- correct the issue and re-deliver the Video, or
- provide an appropriate partial or full refund where correction is not possible.
§7. Prohibited Content and User Responsibility
- The User confirms that all content submitted:
- does not infringe intellectual property rights, privacy or image rights,
- is not unlawful, abusive, hateful, discriminatory, obscene or misleading,
- does not impersonate another person.
- The User bears full responsibility for submitted content.
- If third-party claims arise due to User-supplied content, the User agrees to indemnify the Service Provider for resulting costs, to the extent permitted by law.
- If an Order is cancelled due to prohibited content, the Service Provider may deduct reasonable costs already incurred before issuing any refund.
§8. Intellectual Property
- All rights to the Website, software, AI systems, templates and tools remain the property of the Service Provider or its licensors.
- Upon full payment, the User receives a non-exclusive, non-transferable, perpetual licence to use the delivered Video for personal, non-commercial purposes.
- Commercial use, resale or modification for resale requires a separate written agreement.
- The User warrants that they have the right to provide all materials and personal data used in the Order.
§9. Data Protection
- Personal data is processed in accordance with applicable UK data protection laws.
- Full details are provided in the Privacy Policy, available on the Website.

§10. Final Provisions
- We may update these Terms for valid reasons. Users will be informed in advance where required by law.
- These Terms are governed by the laws of England and Wales.
- Consumers may bring legal proceedings in the courts of their place of residence within the UK.
